Terms of Service

These terms apply when you buy from Caviar Kitchen (“Caviar Kitchen”, “we”, “us”) at caviarkitchen.ca. By placing an order you agree to them.
Who can order
You must be able to enter a binding contract in Ontario, and the delivery address must be within our Toronto / GTA delivery area. We do not deliver to the rest of Canada yet; if no delivery option appears at checkout, your address is outside the area.
Products
We sell farmed sturgeon caviar, sold by species and tin size. Roe is a natural product: colour, grain size and flavour vary between harvests, and photographs on our site are representative rather than exact. Every tin is labelled with its species.
Caviar is a perishable, temperature-sensitive food. Refrigerate it on arrival at 0–4 °C, keep it sealed until you serve it, and eat an opened tin within two to three days.
Prices and payment
Prices are in Canadian dollars (CAD) and are shown on each product page. Prices and availability can change without notice, but the price you see at checkout is the price you pay.
Payment is taken at checkout through Shopify Payments. Your order is a request to buy; the contract forms when we confirm the order by email. If we cannot fulfil an order — stock, a delivery problem, or an obvious pricing error — we will tell you and refund you in full.
If a listing shows a clearly incorrect price, we may cancel the order rather than honour it, and will refund you in full.
Tax
Applicable Canadian taxes, where they apply, are shown at checkout.
Shipping
We deliver within Toronto and the GTA in insulated, cold-chain packaging. Delivery is free on orders of $80 or more, otherwise $5, arriving same day or the next day depending on when you order and on capacity that day.
Same-day is a target, not a guarantee. If a delivery failure spoils an order, contact customer care and we will review it with you.
Someone should be available to receive and refrigerate the parcel. Risk passes to you on delivery.
Returns
All sales are final. Because caviar is perishable we do not accept returns or exchanges on delivered product, opened or unopened, including for change of mind.
If an order arrives damaged, warm, wrong or spoiled, contact our customer care team within 48 hours of delivery and we will review it with you. Outcomes are decided case by case — see our Returns and Refunds policy.
Website content
Our text, photography, illustrations and branding belong to us. You may not copy or reuse them commercially without written permission. Our guides and recipes are offered for general information; you are responsible for handling and storing food safely and for knowing your own allergies.
Accounts and communication
You are responsible for the accuracy of the address and contact details you give us. Orders sent to an incorrect address supplied by you are not our responsibility.
Liability
Nothing here excludes liability that cannot be excluded by law, including under the Consumer Protection Act, 2002 (Ontario) or the Food and Drugs Act (Canada). Subject to that, our total liability for any order is limited to the amount you paid for it.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada, and disputes fall to the courts of Ontario.
Changes
We may update these terms; the version in force is the one published here when you order.
